Swimming Pool Regulations

A building permit is required for above or below ground pools with a capacity of over one thousand (1,000) gallons or one and one-half feet of water depth.

Pools are considered accessory structures.  In order to apply for a building permit to build an accessory structure, you will need to be either a licensed state residential contractor or the property owner with intent to occupy the home.

The Building Permit Application shall be accompanied by plans of sufficient detail to show:
  • The proposed location and size of pool, the house and garage, fencing and other features existing on the lot, such as utility locations, overhead wires and trees; included shall be the location of the above features on all adjacent lots.
  • The location, size and statement as to the types of equipment to be used in connection with the pool, including but not limited to, filter unit, pump, wiring, heating unit, backflush and drainage outlet, fencing and the pool itself.
  • The finished elevations and final treatment around the pool.

A separate building permit is required for any accessory structure in conjunction with a swimming pool (including, but not limited to a pump house, filter house, enclosure for the pool or any other structure erected in).

A seperate Zoning Permit is required for any new fencing constructed in conjunction with a swimming pool.

Location
The pool must be located in the side or rear yard, at least 10 feet from the side and rear property lines. The pool shall not be placed below or above utility lines of any type. Pools shall not be placed in any easements.

Safety Fencing
All pools shall be provided with safeguards to prevent children from gaining uncontrolled access. This shall be accomplished with fencing of not less than five (5) feet in height.

All fence openings or points of entry into the pool area enclosure shall be equipped with gates. All gates shall be equipped with self-closing and self-latching devices placed on top of the gate or otherwise inaccessible to small children.
